Thanks to Virginia Postrel for the links. The importance of overruling Poletown would be difficult for me to overstate. All law students read Poletown in their first year property class. But now, they will read that it is Michigan’s failed experiment with eminent domain. I will be writing extensively about the Hathcock decision in the near future.
