My article Liberal Originalism: A Past for The Future has finally been published in 27 Harv. J. L. & Pub. Pol’y 489 (2004). I’m quite proud of the article—but embarrassed by the editing mistakes, which I hasten to disclaim. For instance:
The Declaration explains that rights are each person’s natural dessert....
Id. at 536. Let the record reflect that I wrote the correct desert, not the incorrect dessert. Also, I’m very annoyed that the editors ignored my explicit instructions as to footnote 2, which reads simply “See The Declaration of Independence (U.S. 1776).” No, no, no! I said See Declaration of Independence, 1 Stat. 1 (1776). I know that’s not how the Bluebook has it, but it’s necessary to make my point that the Declaration is a part of the U.S. Code! This is relevant, since it is the entire thesis of my article.
There are probably other errors, but these ones stood out. Don’t blame me!
